Terms and Conditions

These Terms and Conditions ("Terms") govern your access to the website, web application, software features, integrations, automations, APIs, related services, and any other products or features provided under the EvolForge brand by Individual Entrepreneur (FOP) Leskiv Yustyna Romanivna ("EvolForge", "we", "us", "our").

Please read these Terms carefully before using the service.

By using EvolForge, creating an account, logging in, clicking a confirmation button, or otherwise accessing the service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy at https://evolforge.com/en/privacy-policy.

If you do not agree to these Terms, you may not use EvolForge.

1. Who provides the service

The EvolForge service is provided by:

2. To whom these Terms apply

These Terms apply to all persons who:

  • visit the EvolForge website;
  • register an account;
  • use the web application;
  • connect integrations;
  • use paid or free features of the service;
  • interact with our APIs, automation workflows, or other technical capabilities of the platform.

If you use the service on behalf of a company, individual entrepreneur, organization, or other legal entity, you confirm that you have sufficient authority to agree to these Terms on behalf of such entity. In this case, the words "you" and "your" also mean the respective legal entity.

3. Service description

EvolForge is a software platform that may provide tools for automation, integrations, messaging, business process setup, scenario management, third-party service connections, data processing, management interfaces, related APIs, and other features that we make available from time to time.

We may change, supplement, update, limit, or discontinue any part of the service at any time if necessary for:

  • product development;
  • security;
  • technical stability;
  • compliance with legislation;
  • fulfillment of third-party platform requirements;
  • changes in the business model or structure of the service.

We do not guarantee that a specific feature, integration, or section of the service will be available permanently, continuously, or in an unchanged form.

4. Right to use the service

You may use EvolForge only provided that:

  • you have the right to enter into binding contracts;
  • your use of the service does not violate applicable laws;
  • you are not under sanctions, export restrictions, or other prohibitions that make the lawful use of the service impossible;
  • you will not use the service in a way that violates the rights of third parties or the rules of third-party platforms.

Minimum user age: 18 years

5. Account registration

To access certain features of EvolForge, you may need to create an account.

During registration, you agree to:

  • provide accurate, current, and complete information;
  • not impersonate another person;
  • not create accounts with false data;
  • keep your account information up to date;
  • not share account access with unauthorized persons.

You are responsible for:

  • maintaining the confidentiality of your credentials;
  • all activities that occur under your account;
  • immediately notifying us of any unauthorized access or suspicious activity.

We reserve the right to require verification of identity, account ownership, or the right to use certain integrations or features.

6. Acceptable use of the service

You agree to use EvolForge only lawfully, in good faith, and in accordance with these Terms.

You are prohibited from:

  • using the service for illegal activities;
  • sending spam, fraudulent, deceptive, or unauthorized messages;
  • violating intellectual property rights, privacy, or other rights of third parties;
  • uploading or transmitting malicious code, viruses, trojans, exploit tools, or other dangerous components;
  • attempting to gain unauthorized access to systems, networks, accounts, or data;
  • bypassing technical limitations, quotas, rate limits, security mechanisms, or access controls;
  • using the service for harassment, discrimination, threats, or other abuses;
  • using the service in a way that could overload the infrastructure or pose a risk to its stability;
  • copying, modifying, disassembling, decompiling, or otherwise attempting to derive the source code of the service, unless expressly permitted by law;
  • using the service in violation of the rules of third-party platforms you work with through EvolForge;
  • using the service to process or transmit data without proper rights, permissions, or legal grounds.

We may establish additional rules of acceptable use for specific features, integrations, APIs, or pricing plans.

7. Integrations with third-party services

EvolForge may support integrations with third-party platforms, services, or APIs, including Meta, Facebook, Instagram, and other providers.

When you connect a third-party integration, you confirm that:

  • you have the right to connect the respective account, page, business account, API, or other asset;
  • you have all necessary permissions, consents, and legal grounds to process the relevant data;
  • you will comply with the rules, policies, and terms of the respective third-party platform;
  • you understand that the availability, stability, and functionality of the integration may depend on the decisions, policies, or technical changes of the third party.

We are not responsible for:

  • changes to third-party APIs or policies;
  • access restrictions imposed by third-party platforms;
  • blocks, disconnections, or sanctions imposed by a third-party platform;
  • loss of functionality due to changes on the integration side;
  • actions or omissions of third-party services.

If a third-party platform requires modifying, limiting, or terminating the use of a specific integration, we reserve the right to take appropriate action immediately.

8. User data and your content

In these Terms, "your content" means any text, files, configurations, settings, scripts, automations, data, messages, templates, instructions, input materials, requests, and other information that you upload, create, transmit, store, or process through EvolForge.

You retain ownership of your content to the extent such rights belong to you.

You grant us a limited, non-exclusive, revocable (to the extent permitted by these Terms) license to use your content only as necessary for:

  • providing the service;
  • hosting and technical processing;
  • displaying information in your account;
  • running your configured workflows and integrations;
  • technical support;
  • ensuring security;
  • backups;
  • complying with legal requirements.

You represent and warrant that:

  • you have the right to upload, use, and process such content;
  • your content does not violate the law, third-party rights, or the terms of third-party platforms;
  • you are responsible for the legality, accuracy, and appropriateness of your data and content.

9. Personal data and privacy

By using the service, you acknowledge that you have read the Privacy Policy.

If you use EvolForge to process third-party data, you are solely responsible for:

  • having proper legal grounds;
  • informing data subjects, if required;
  • complying with applicable legal requirements;
  • the lawful use of integrations, communication channels, and external platforms.

10. Intellectual property

All rights to EvolForge, including software code, interface, design, service structure, databases, texts, graphics, logos, trademarks, documentation, and other materials, belong to us or our licensors and are protected by applicable law.

Except as expressly permitted by these Terms, you may not:

  • copy the service or its parts;
  • create derivative works;
  • resell, sublicense, or transfer the service without our written permission;
  • use our brands, logos, or trademarks without approval.

We grant you a limited, non-exclusive, non-transferable, revocable right to use the service solely for its lawful use in accordance with these Terms.

11. Feedback and suggestions

If you provide us with ideas, feedback, suggestions, or recommendations regarding the service ("Feedback"), we may use such Feedback without restrictions and without any obligation to compensate you, provided that this does not contradict applicable law or separately agreed written terms.

12. Service availability

We strive to maintain the stable operation of EvolForge, but we do not guarantee that the service will be:

  • uninterrupted;
  • error-free;
  • constantly available;
  • fully compatible with any third-party service or environment.

We may perform technical maintenance, updates, emergency shutdowns, infrastructure changes, or access restrictions without prior notice if necessary for the security, stability, or support of the service.

13. Suspension and termination of access

We have the right to immediately suspend, limit, or terminate your access to EvolForge in whole or in part if:

  • you violate these Terms;
  • we reasonably suspect fraud, abuse, or unauthorized activity;
  • your use poses a risk to the security, stability, or reputation of the service;
  • required by law, court, government agency, or a third-party platform;
  • you fail to make due payments;
  • we discontinue the respective feature, plan, or service.

You may also stop using the service at any time by deleting your account or contacting us.

Termination of access does not relieve you of obligations that by their nature should survive termination, including those relating to payment, liability, intellectual property, confidentiality, disputes, and other provisions that are intended to survive the termination of the agreement.

14. No warranties

To the extent permitted by applicable law, EvolForge is provided on an "as is" and "as available" basis.

We make no express or implied warranties, including warranties of:

  • merchantability;
  • fitness for a particular purpose;
  • error-free operation;
  • uninterrupted availability;
  • meeting your expectations;
  • non-infringement of third-party rights;
  • compatibility with any third-party services, platforms, or channels.

We do not guarantee that:

  • the service will always be available;
  • the result of using the service will be accurate, sufficient, or legally flawless;
  • any integration with a third-party platform will operate uninterrupted;
  • using the service will automatically ensure your compliance with any regulatory requirements without your own actions and checks.

15. Limitation of liability

To the extent permitted by law, we shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including:

  • loss of profit;
  • loss of revenue;
  • loss of data;
  • loss of customers;
  • loss of business reputation;
  • interruption of business processes;
  • costs of replacing the service;
  • consequences of actions by third-party platforms or integrations.

Nothing in these Terms limits liability that cannot be limited or excluded by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, directors, employees, contractors, and partners from any claims, demands, disputes, damages, losses, costs, and legal fees arising out of or relating to:

  • your use of the service;
  • your content or data;
  • your violation of these Terms;
  • your violation of third-party rights;
  • unlawful use of third-party platforms or integrations through EvolForge;
  • your violation of applicable law.

17. Compliance with third-party platform rules

If you use EvolForge in conjunction with Meta, Facebook, Instagram, or other third-party platforms, you are solely responsible for complying with the rules, policies, terms, and technical requirements of such platforms.

The availability of an integration in EvolForge does not mean that we:

  • are affiliated with the respective platform;
  • guarantee unconditional approval of your use case;
  • guarantee uninterrupted access to APIs or data;
  • assume your legal responsibility to the third-party platform.

Third-party names, trademarks, and brands belong to their respective owners and are used solely to identify integrations or compatibility.

18. Export restrictions and sanctions

You may not use EvolForge if doing so violates sanctions regimes, export restrictions, trade embargoes, or other mandatory regulations applicable to you or the relevant transaction.

You confirm that you will not use the service in a manner that directly or indirectly facilitates the violation of such restrictions.

19. Force majeure

We are not liable for any failure or delay in performing our obligations if such failure or delay is caused by circumstances beyond our reasonable control, including:

  • accidents;
  • power outages;
  • cyberattacks;
  • cloud infrastructure failures;
  • outages or changes to third-party APIs;
  • actions of government authorities;
  • war;
  • acts of terrorism;
  • strikes;
  • natural disasters;
  • network or data center issues.

20. Changes to these Terms

We may modify these Terms from time to time.

When updated, we will change the "Last Updated" date at the top of the page. If the changes are material, we may provide additional notice through the website, web application, email, or other appropriate means.

Your continued use of EvolForge after the updated Terms become effective constitutes your acceptance of the updated version to the extent permitted by law.

21. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions will remain in full force and effect, unless otherwise required by the nature of the relevant provision or the requirements of the law.

22. No waiver

Our failure or delay in exercising any right or remedy under these Terms does not constitute a waiver of such right or remedy.

23. Entire agreement

These Terms, together with the Privacy Policy, Data Deletion Policy, specific pricing terms, Data Processing Addendum, SLA, or other written documents expressly referenced by us, constitute the entire agreement between you and us regarding the use of EvolForge, unless otherwise agreed in writing.
